Federal Firearms Transfer Laws


You are permitted to buy firearms out of state, but the seller must deliver them to a Federal Firearm License (FFL) dealer in your home state. The dealer will notify you when he/she receives the firearm and arrange for you to come to their business. You will be required to fill out an ATF Form 4473, Firearm Transaction Record either electronically or on paper. Once the dealer has reviewed the form and completed their sections, it will be submitted electronically or via phone for a National Instant Criminal Background Check System (NICS)check, If you hold a concealed carry permit that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) accepts as a substitute for  the NICS check the dealer will transfer the firearm to you. If you are denied or delayed the dealer is not allowed to transfer the firearm. There may also be state or local laws and regulations that govern this type of transaction.
